1. Acceptance of these terms
By using files.co.ke (the "site", "we", "us") you agree to these terms. If you do not agree, please do not use the site.
2. What we provide
files.co.ke is an online marketplace for digital files made for Kenyan teachers, learners and professionals: for example notes, schemes of work, exams and past papers. Some files are free and some are paid. Files are published by us and by creators who sell through the site.
3. Using the site
You agree to use the site lawfully and fairly. You must not:
- attempt to disrupt or overload the service, or scrape it at scale;
- bypass payment or access files you have not paid for;
- use the site to break the law or infringe anyone's rights.
4. Licence to use files
When you buy or download a file you get a personal, non-exclusive, non-transferable licence to use it for your own teaching, learning or work.
- You may print and edit the file for your own use and your own classes.
- You may not resell, redistribute, upload to other sites, or share your purchase publicly.
- Use by a whole school or several teachers needs permission from us; contact us to arrange it.
Copyright and other rights in each file stay with us or with the creator who made it.
5. Prices and payment
Prices are shown in Kenyan Shillings (KSh). You pay by M-Pesa. Payments are processed by our payment processor, Shupavu, which sends the M-Pesa prompt to your phone and confirms the result to us. We never see or store your M-Pesa PIN. An order is complete once the payment is confirmed.
6. Delivery of digital files
Files are delivered digitally. After payment is confirmed your download unlocks straight away on the page and in "My Files" on the same device. Download links are tied to your purchase. Because browser data can be cleared, please download and keep your own copy of every file you buy.
7. Refunds for digital goods
Because files are digital and available immediately, purchases are generally final once the file has been delivered. We will fix the problem or refund you if:
- the file is corrupted, will not open, or is missing;
- the file is materially different from its description or previews; or
- you were charged more than once for the same file.
Contact us within 7 days of the purchase with your M-Pesa confirmation message or order reference at [email protected]. Approved refunds are returned to the M-Pesa number that paid.
8. Creator content, copyright and takedown
Creators who list files must own, or have the right to sell, everything they upload, and must not upload copied, unlawful or misleading content. If you believe a file on the site infringes your rights, email [email protected] with the link to the page, what is yours, and how to reach you. We review notices promptly and remove content where appropriate.
9. Disclaimers
Files are provided to support teaching, learning and work. We take care over their quality, but we do not guarantee that a file suits every class or purpose, or that it will produce a particular result. The site is provided "as is" and may be unavailable from time to time.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss. Our total liability for any claim about a purchase is limited to the amount you paid for that purchase. Nothing in these terms limits rights you have under Kenyan consumer protection law.
11. Governing law
These terms are governed by the laws of Kenya, and the Kenyan courts have jurisdiction over any dispute.
12. Changes to these terms
We may update these terms from time to time. The date at the top shows the latest version. Continuing to use the site after a change means you accept the updated terms.
